I am unable to access Settings or find out the IMEI number because the phone will not activate and I cannot access any of these functions let alone the home screen. All I get is the annoying startup thing. As I've already stated, if they originally advertised the phone as "unlocked", they misrepresented it. File a complaint with the auction site and try to get your money back. Is there any legal action that can be taken against him? Is there a way to un-Jailbreak a device? My previous 3GS which got stolen wasn't jailbroken, it'd be great if I can somehow manage to swap the soul from this phone to whatever that's saved in my computer from constant backup.
Again, though, what "online auction" did you buy it from? Because you should take recourse through there. No idea, and likely will cost you more to formally find out then you'd ever get back in compensation. Is the seller even in your home country? Is the auction site hosted by a company in your home country? This is a very common issue when buying used iPhones over the internet from unknown people or sources, and one of the reasons folks here will strongly encourage people to only buy from Apple or true Apple Authorized resellers such as officially supported carriers.
All Apple Authorized resellers can be found on Apple's own web site and if a company is not listed there, it is not an Apple Authorized reseller.
It is the only way to know what you are getting, and to have recourse if you feel you do not get what you expected. I very seriously doubt it. Most auctions sell items 'as is'.
